By using Pacifecon Online (the “Website”), or any other Pacifecon Reports (the “Reports”) emailed or otherwise, you are accepting the following terms and conditions:

Terms and Conditions (“the Terms”)
By logging on to Pacifecon Online www.pacifecon.co.nz (the “Website”) or by accessing PACIFECON data contained within the website via an affiliate application, you agree to be bound by the Terms and Conditions (the “Terms”). as set out below. If you do not agree to the Terms please do not continue to log on or use the Website.
We may from time to time amend the Terms and will notify you of this by updating the “last updated notice” beside the link to the Terms on the login screen. By continuing to access and use the Website you agree to be bound by the amended Terms.
The reports available on the Website, by email or any other means (the “Reports”) are prepared by PACIFECON and are supplied only on contract restricting circulation internally, solely to those within the subscribers’ company or organisation. Reproduction or sharing of PACIFECON copyright material with any person or organisation other than the recognised subscriber is forbidden without prior written consent. Where separate business entities operate under an umbrella organisation of any kind, subscriptions must be purchased by each business unit unless prior arrangements are made with PACIFECON and are confirmed in writing.

The information provided via the Website and Reports does not take into account the particular objectives, situation, or needs of any individual user. You should assess whether it is appropriate in light of your own objectives, situation, and needs. You, and your company or organisation, are solely responsible for your reliance on the information provided, on the Website and in the Reports, and the reliance of anyone you provide it to within your company or organisation. You will indemnify PACIFECON against any liability that may incur as a result of any reliance on the information taken from the Website and in the Reports, or the reliance by anyone you may provide that information to. PACIFECON will not be liable to you (or to anyone you provide the information or Reports to) for any indirect or consequential loss that might be suffered as a result of use or reliance on the information or Reports.

All reasonable measures have been taken to ensure that the information provided on the Pacifecon Website and in the Reports is accurate, complete, categorised correctly, and up to date (as at the publish date reported). If you believe any of the information in the Reports to be inaccurate, please contact us at projects@pacifecon.co.nz.

As set out above, PACIFECON excludes all warranties (expressed or implied), in relation to information provided on the Website and Reports. Should PACIFECON be found to be liable to you, that liability will not exceed the amount paid by you to PACIFECON in the current quarter.

You, as the Subscriber, or nominated user of PACIFECON data, are responsible for ensuring you comply with all applicable NZ laws and regulations. There is no implied or actual permission for the Subscriber to mass email persons included in the Website or any of the Reports provided by PACIFECON.

PACIFECON reserves the right to terminate access to PACIFECON data through the Website or Reports for any breach of these Terms.

Subscription Terms
The minimum PACIFECON Online subscription term is 12 (twelve) months. By commencing an online subscription your company has committed to the full 12 (twelve) month term or more where multiple years are confirmed. This subscription term includes additional benefits and/or Reports agreed to by your company or organisation.

Under exceptional circumstances PACIFECON reserves the right to offer your company the option to put the subscription on hold for up to three (3) months during the subscription term if your company has either paid their subscription in full or is up-to-date with subscription instalments. During the agreed “on-hold period” the subscribers do not have access to the PACIFECON Website and/or any reports or information that is covered under the agreed subscription. The agreed period of time of the on-hold period will be added to the end of the subscription once the on-hold period lapses and the subscription is reactivated, thereby extending the original renewal date accordingly.

Non payment
If your company has chosen to pay the subscription amount as in agreed instalments, there is an obligation to keep up-to-date with payments as scheduled and agreed. If payment has not been received in the expected timeframe and there has been no agreement made with PACIFECON to change the payment schedule due to extraordinary circumstances, PACIFECON reserves the right to temporarily cease PACIFECON Online access (the Website) and/or stop sending Report/s, until outstanding payments are fully paid. Once the payment arrears have been cleared, the Pacifecon Online access for your company will be reopened, and/or Reports will continue to be provided. All costs incurred by us as a result of a default by you including, but not limited to, administration charges, debt collection costs and legal costs as between solicitor and client are payable by your company.

Names, images, and logos
The names, images, and logos identifying PACIFECON and any of its subsidiaries and third parties and their information, products, and services, are proprietary marks of PACIFECON or third parties. If you have received approval to link to the PACIFECON Website you may use the logo in conjunction with the link only if you have received prior permission to do so. No other use of our logos, or any third party logos, accessed via the PACIFECON website, is permitted without prior approval from the relevant copyright owner. Requests for permission to use our logos should be directed to the Website owner at projects@pacifecon.co.nz. Explain how and why you wish to use our logo. Please include your name, organisation, telephone number, and email address.

External links on the website
We are not responsible for the content or reliability of linked websites and listing should not be taken as endorsement of any kind. We have no control over the availability of linked pages.

Friend referral terms & conditions:

  • Promotion starts from 11 September 2023, only referrals made after this date will be eligible 
  • If a person is referred to Pacifecon more than once, the Prezzy Card will go to the first person who referred them
  • Referral bonus is given out in two halves – once when the individual/organisation completes a demo and once when the individual/organisation has signed up to an online subscription with Pacifecon
  • Pacifecon team will complete an evaluation on the referred person to ensure they’re suitable for our services. On some occasions, we may not offer a demo. 
  • The individual who has made the referral will be contacted within 30 business days of the referred person completing the above requirement
  • Bonus will be provided via a digital prezzy card to be sent via the referring person’s provided email address
  • Bonus cannot be exchanged for cash or any other goods
  • Prezzy Card T&Cs may apply – please refer to the issuer
